Terms and Conditions
These terms and conditions (hereinafter referred to as "terms") apply solely to the renovation matching service platform provided by the HONG KONG DECOLAND LIMITED (hereinafter referred to as "DECOLAND"). Please read these terms carefully before using the service. By using this service, users agree to and accept the binding nature of these terms. DECOLAND reserves the right to revise these terms from time to time, and such revisions will take effect upon being posted on its website or application. DECOLAND also reserves the right to add, modify, or terminate any or all parts of the service at any time.
If you continue to use the service after the revised terms are published, it indicates that you agree to be bound by the revised terms.
I. Platform Services
1.1 The platform provides renovation information sharing and matches users with renovation professionals. Users can browse renovation information through this platform.
1.2 Renovation companies and professionals introduced by this platform provide their renovation information. While DECOLAND strives to ensure the accuracy and validity of this information, it does not take any responsibility for its correctness or validity.
II. This Service
2.1 DECOLAND offers renovation information sharing and referrals to renovation professionals and guides renovation projects. Users can use the platform's services to browse and search.
2.1.1 Information related to renovation, contact details, service content, promotions, construction guidelines, and others on this platform's system, website, and social platforms are available for free.
2.2 When DECOLAND receives renovation inquiries, requests, designs, and other services from you, the platform will notify the renovation and design consultant team, which will then contact you to understand your detailed needs, conduct on-site assessments, and screen (including but not limited to design requirements, styles, renovation unit regions, renovation companies, professionals, design intentions, etc.) to find the most suitable renovation team, professionals, and design companies for you.
2.3 This service will match you with professionals, craftsmen, designers, renovation companies, and design companies. They will then provide backend support services (including but not limited to design, supervision, coordination, communication, etc.) based on reasonable circumstances.
2.4 The professionals, craftsmen, designers, renovation companies, and design companies introduced by this service, as well as the related renovation information provided, are offered by these entities or other independent third-party providers ("Third-Party Providers"). While the platform strives to ensure the accuracy and validity of this information, it does not take any responsibility for its accuracy or completeness.
2.5 This service does not include the provision of renovation services. The platform does not bear any legal responsibility for contracts between you and the professionals.
III. Purpose of Collecting and Using Personal Data
You agree to cooperate with DECOLAND for the provision of this service in the following areas:
3.1 You can transmit, submit, or register renovation or personal data, and agree to or authorize DECOLAND to collect, transmit, or use it for other purposes.
3.2 You agree to ensure that such information is accurate, complete, and up-to-date. If you fail to maintain the accuracy, completeness, and timeliness of this information, you may be unable to use this service, or it may lead to the termination of these terms by DECOLAND. Without prejudice to our other rights under the law or otherwise, we reserve the right to terminate or suspend your service by giving you at least 14 days prior notice (in emergencies, we may terminate or suspend your service immediately without prior notice).
3.3 You agree and understand:
3.3.1 You must assess the conditions of such professionals on your own and decide to assign projects to them.
3.3.2 You should not, in any form, independently appoint the introduced professionals, craftsmen, designers, renovation companies, and design companies to establish a contractual relationship.
3.3.3 If you decide to assign projects to such professionals, you should promptly sign the standard quotation form provided by DECOLAND, and this quotation form will serve as the official contract for the project. You and the professionals, craftsmen, designers, renovation companies, and design companies should fulfill the contract based on the terms specified in the contract.
IV. Restrictions
You must not:
4.1 Access or use our services in any unauthorized manner (or allow access or use). This includes (but is not limited to): any false, fraudulent, or unauthorized access or attempt to access any of our website data or accounts or any other user's data; and causing any interference or interruption to our services.
4.2 You can only access and use our services according to these terms and conditions, solely for personal and non-commercial purposes to inquire about the status of the provided services, [and to conduct legal and authorized transactions with us], and for no other purpose.
V. Intellectual Property Rights
5.1 All trademark rights, copyrights, database rights, and other intellectual property rights of the content and/or materials on DECOLAND, including names, logos, organization, and layout designs, as well as related software coding, belong to us or our licensors. You can only use such content and/or materials strictly by these terms of use. Any other means of using, reproducing, transmitting, or processing such content without our prior written consent is prohibited and will constitute a breach of these terms.
5.2 When you upload or transmit data protected by intellectual property rights (such as photos and videos) on the DECOLAND system, you grant DECOLAND a non-exclusive, transferable, sublicensable license to use such protected data for free. You declare and guarantee that you will not upload or transmit any infringing data.
VI. Third-Party Websites, Content, Products, and Services
6.1 Our website contains or provides access to information concerning third-party websites, applications, content, products, or services. This could be through hyperlinks to third-party sites or other methods. Such content is subject to the terms and conditions set by the third-party owners. We have no control over these third-party materials and do not endorse them. We will not be held legally responsible for how you handle matters involving these third parties. All responsibility for dealings with third-party websites, applications, content, products, or services lies with you.
VII. Disclosure of Personal Data
7.1 We may disclose and transfer your personal or renovation data (whether in Hong Kong or overseas) to:
7.1.1 Institutions providing services related to DECOLAND;
7.1.2 Our affiliated companies and business partners;
7.1.3 Regulatory authorities, law enforcement agencies, and courts; and
7.1.4 Our professional advisors.
7.2 You declare and guarantee that you will not disclose information about the renovators or companies provided by DECOLAND while using our services to third parties, including their personal data.
VIII. Disclaimer
8.1 While we have taken great care in compiling the information and materials for our services, they are provided "as is" without any form of warranty or representation, whether express or implied. Specifically, we do not provide warranties or representations concerning non-infringement, security, accuracy, fitness for a particular purpose, or absence of computer viruses.
8.2 Except for claims permissible under applicable consumer protection laws, we will not be legally responsible for any loss or damage (whether direct, indirect, special, or consequential) incurred by you or any other person due to negligence, tort, breach of contract, or other reasons arising from or in relation to:
8.2.1 Access to or use of our services;
8.2.2 Interruptions, defects, technical errors, or other harmful elements associated with our services.
The above exclusions and limitations apply fully where legally permissible. These terms do not exclude or limit our liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability which cannot be excluded or limited by Hong Kong law.
8.3 You agree and understand that the contract content between you and the companies or renovators referred by the platform is not controlled or supervised by DECOLAND, and the platform will not bear any legal responsibility for it.
8.4 DECOLAND will not directly intervene in any aspect of the renovators, companies, or other individuals you choose, including but not limited to, craftsmanship, quality, or the construction process. However, DECOLAND strives to screen partners from various perspectives (including but not limited to scale, design, renovators, quality, or follow-up services) and conducts regular supervision or reporting for assessment.
IX. Compensation
9.1 You are responsible for compensating all related parties of DECOLAND, such as consultants, renovation company personnel, professionals, insurance personnel, etc., for any costs, including reasonable attorney fees, arising from or any liabilities pursued due to your use of this service.
X. System Service
10.1 DECOLAND may periodically suspend or terminate the use of the service for maintenance or service updates. The platform bears no legal liability for any direct or indirect losses that this may cause to you.
XI. Governing Law and Jurisdiction
11.1 These terms and conditions are governed by and interpreted by the laws of Hong Kong. You agree to the exclusive jurisdiction of the Hong Kong courts for any legal actions that may arise from your use of our website or these terms and conditions. We reserve the right to take legal action against you for violating these terms and conditions in your country of residence or any other relevant country/region.
